Here one of the HOA's put a lien on a home that was twice the value of the home to cover their costs of filing a lawsuit against a homeowner because his flag pole was 40' TOO tall.

In Texas they can foreclose without a court order for non-payment of fees or fines.  So you lose your job, slack off on the fees in favor of food or electricity, and lose your house.  No recourse; you signed the HOA agreement.
In NJ, all they can do is put a lien on your house and get their fees and legal fees back when your house is sold.

Foreigner's question - these Homeowner Associations, are you told you will be in such an area before you buy the house?  And, from interpreting the post above, do they have the power to fine you for breaking their rules on your own property?

yes and yes.  in a way it is a subtle form of discrimination, since few can afford both the house payment and the HOA's fees.  keeps the low income families out and their home values higher.  JMHO.

Agreed.  I have no interest in amenities like pools or community centers where I can go play dominoes, so I live in a not quite-so-nice development, but my house is very nice on the inside.  My HOA dues are not bad at all, $115 per quarter.  In NJ with no amenities, it was $85 per year.

Thank you.  We have areas here with Residents' Committees but they have no teeth.  They act in the interest of people living in a particular area and their represesntaives will approach politicians or Government agencies on the peoples' behalf but any action taken is taken by the authorities.  In my own area the local committee petitioned the Counsellors for traffic calming road alterations which will start soon and things like receptacles for dog walkers to put their dogs' poo in.  If anyone attempted to set up a committee to charge people for having their personal business regulatated on their own property it wouldn't have much of a start.  There's enough control by Local Council and Government.

My family lived in Brooklyn for 100 years, both sides.  My mother's side came from Germany, my father's side came from Canada. You will never convince me I'm not hard-headed!

Both sides of my family are from Virginia.  My father's side traces all the way back to the Jamestown colony.  I was 12 before I found out dam Yankee was 2 words.

LOL... you would do well down here in the south young man... I don't know much about them Canadians, but them Germans... they know how to cook buddy, spent three years over their when we were stationed at Hahn Air Base which makes me an Air Force Brat and a rebel! Grin

There was something on the next a couple of years ago about a retired CSM (command sergeant major) (In Florida I think. The highest non com in the Army. He put a American flag on his front lawn & they tried to take him to court to get rid of it cause it ruined the look of the front of his house.  He won the case.  beer

And you get away with that in Denton How?

I got smart when we moved into this house there was no HOA then the town pressured us to set one up, I volunteered to be president the first year and, basically grandfathered anyone who owned the house for more than 10 years to be able to do anything, we are the newest people on the block and have been here for 15 years already.  We have 8 acres and are one of the smaller lots in the association but with my Ham Tower, wood fired kiln, Bee Hives and animals I would give nightmares to anyone who wanted to put in restrictions.
